Terms and Conditions and Privacy Policy for LEOKIDS
1. Definitions
For the purposes of these Terms and Conditions:
- Carrier means a third party responsible for delivering the shipment to the Customer.
- Terms and Conditions or Terms means these Terms and Conditions of the Online Store.
- Customer or Buyer means a natural person, legal person or other entity with legal capacity under applicable law, placing an Order through the Store.
- Online Store or Store means the online shop available at https://leokids.uk/.
- Goods or Products means the products presented and offered for sale in the Store.
- Sales Agreement means the distance contract for the sale of Goods concluded between LEOKIDS LTD and the Customer through the Store.
- User means a person or entity that has registered an account in the Store.
- Owner or Seller means LEOKIDS LTD, a company registered in Scotland under company number SC886291, with its registered office at 5 South Charlotte Street, Edinburgh, Scotland, EH2 4AN.
- Order means the Customer's declaration of intent aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of Goods.
2. General Provisions and Seller Details
- These Terms set out the rules for the use of the Store, the conditions of sale, and the rights and obligations of Customers and the Seller in relation to purchases made via the Store.
- The Store is operated by LEOKIDS LTD, company number SC886291, with its registered office at 5 South Charlotte Street, Edinburgh, Scotland, EH2 4AN.
- The Store may be contacted via the contact form available on the website, by telephone at +44 794 440 13 84, and by e-mail at [email protected]
- These Terms apply to all Orders placed through the Store.
3. Eligibility and Use of the Store
- To place an Order, the Customer must have access to the Internet, a web browser, and an active e-mail address.
- The Seller may allow purchases through a registered customer account. During registration, the Customer should provide accurate and complete information, including name, surname, e-mail address, password, delivery address and telephone number. The Customer is responsible for keeping account credentials confidential.
- The Customer may review and update account details and order history through the “My Account” section.
4. Goods, Orders and Contract Formation
- Information about Goods displayed in the Store, including descriptions, specifications, images and prices, constitutes an invitation to treat and not a binding offer.
- To place an Order, the Customer must complete the online order form, select the preferred delivery and payment method, accept these Terms, and click the relevant confirmation button.
- Placing an Order constitutes an offer by the Customer to purchase the selected Goods.
- A Sales Agreement is concluded only when the Seller confirms acceptance of the Order for processing by e-mail.
- Orders may be placed 24 hours a day, seven days a week, subject to technical interruptions or maintenance.
- The Seller may also accept orders via social media channels, including Instagram, where expressly stated.
5. Product Availability and Order Fulfilment
- The Seller makes reasonable efforts to ensure that products shown as available in the Store correspond to actual stock levels.
- If the ordered Goods become unavailable, in whole or in part, the Seller will inform the Customer promptly. If the Seller cannot fulfil the Order, the Customer will be offered either a refund or, where appropriate, substitute goods of equivalent quality and price.
- Orders are usually dispatched within 48 hours after payment has been received, or within 48 hours after the Order is placed in the case of cash on delivery, if such option is offered.
- Delivery times shown in the Store are estimates and should be increased by the time required by the Carrier to complete delivery.
- Delivery is available within the United Kingdom and, where offered by the Store, to other countries indicated during checkout.
- The Seller is not responsible for delays caused by the Customer providing incorrect or incomplete delivery information.
6. Prices and Payment
- Unless stated otherwise, all prices displayed in the Store are final gross prices and include VAT where applicable.
- Delivery costs are charged in addition to the product price and are shown during checkout before the Order is placed.
- The price displayed in the Store at the time the Order is placed is binding for that Order.
- The Seller may change prices, introduce or withdraw products, and launch or end promotions at any time, but such changes will not affect Orders already accepted.
- The Store may offer payment by bank transfer, online payment provider, PayPal and cash on delivery, depending on the options displayed during checkout.
- If payment by traditional bank transfer is selected, payment must be made within 3 days from the date of the Order. If payment is not received within that time, the Order may be cancelled.
- If cash on delivery is offered, an additional fee may apply as indicated during checkout.
7. Delivery and Receipt of Goods
- The Goods will be delivered to the address specified by the Customer during checkout.
- The Customer should inspect the parcel upon delivery and, where possible, report visible damage in the presence of the Carrier and request a delivery damage report.
- A receipt or, where requested and legally required, an invoice will be issued for the Order.
- The Seller undertakes to deliver Goods that conform with the Sales Agreement.
8. Right to Cancel / Withdraw
- If the Customer is a consumer, the Customer has the right to withdraw from the Sales Agreement within 14 days without giving any reason, starting from the day on which the Customer or a person indicated by the Customer receives the Goods.
- To exercise the right of withdrawal, the Customer must notify the Seller of the decision to withdraw by a clear statement sent by e-mail or post, or by using the withdrawal form made available by the Seller.
- The Customer must send back the Goods without undue delay and no later than 14 days from the date on which the Customer informed the Seller of the withdrawal.
- The Customer is liable only for any diminished value of the Goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Goods.
- The Seller will reimburse all payments received from the Customer, including the cost of standard delivery, without undue delay and no later than 14 days from the day on which the Seller is informed of the withdrawal. The Seller may withhold reimbursement until the Goods have been received back or the Customer has supplied evidence of having sent back the Goods, whichever is earlier.
- The refund will be made using the same means of payment as the Customer used for the original transaction, unless the Customer expressly agrees otherwise.
- The right of withdrawal does not apply to sealed goods which are not suitable for return for health protection or hygiene reasons if they become unsealed after delivery.
9. Complaints and Non-Conforming Goods
- If the Goods delivered are defective, damaged, incomplete or otherwise not in conformity with the contract, the Customer may submit a complaint to the Seller by e-mail at [email protected] or by post to the Seller's registered office.
- The complaint should include, where possible, the Customer's details, order number, a description of the issue, and photographs or other supporting evidence.
- The Seller will review the complaint and respond within 14 days of receipt.
- Where the complaint is justified, the Seller will provide an appropriate remedy in accordance with applicable consumer law, such as repair, replacement, price reduction or refund.
- The Seller does not accept parcels returned cash on delivery unless agreed in advance.
10. Cancellation Before Dispatch
- The Customer may request changes to an Order or cancel it until the Goods have been dispatched. Such requests should be sent promptly to [email protected].
- If the Order process is not completed by the Customer, no Sales Agreement is concluded and the Order will not be processed.
11. Personal Data
- The controller of personal data processed in connection with the Store is LEOKIDS LTD, company number SC886291, registered office: 5 South Charlotte Street, Edinburgh, Scotland, EH2 4AN.
- Personal data are processed for the purposes of:
- setting up and operating a customer account;
- processing Orders and performing Sales Agreements;
- arranging delivery and payment;
- handling complaints, returns and withdrawal requests;
- complying with legal and tax obligations;
- establishing, exercising or defending legal claims; and
- sending newsletters or marketing communications, where consent has been given.
- Personal data are processed on the basis of contract performance, compliance with legal obligations, legitimate interests of the Seller, and consent where required.
- Personal data may be shared with trusted third parties, including payment service providers, couriers, IT and hosting providers, accountants, legal advisers and competent public authorities where required by law.
- The Customer has the right to access, rectify, erase, restrict processing of, object to processing of, and port personal data, as well as the right to withdraw consent at any time where processing is based on consent.
- The Customer also has the right to lodge a complaint with the competent data protection authority.
12. Cookies
- The Store uses cookies and similar technologies to ensure the proper functioning of the website, improve user experience, analyse traffic and, where applicable, support marketing activities.
- Users can manage cookies through their browser settings. Disabling some cookies may affect the proper functioning of certain features of the Store.
13. Liability
- Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory consumer rights.
- To the maximum extent permitted by law, the Seller shall not be liable for interruptions or technical issues affecting the Store caused by force majeure, third-party systems, or circumstances beyond the Seller's reasonable control.
14. Governing Law and Consumer Rights
- These Terms shall be governed by the laws of Scotland, without prejudice to any mandatory consumer protection rights applicable in the Customer's country of habitual residence.
